| حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ : أَنَّ عَائِشَةَ أُمَّ الْمُؤْمِنِينَ ، أَرَادَتْ أَنْ تَشْتَرِيَ جَارِيَةً فَتُعْتِقَهَا ، فَقَالَ أَهْلُهَا : نَبِيعُكِهَا عَلَى أَنَّ وَلَاءَهَا لَنَا ، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : لَا يَمْنَعُكِ ذَلِكَ ، ” فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ ” . |

| ´ہم سے عبداللہ بن یوسف نے بیان کیا، کہا کہ ہم کو امام مالک رحمہ اللہ نے خبر دی، انہیں نافع نے اور انہیں عبداللہ بن عمر رضی اللہ عنہما نے کہ` ام المؤمنین عائشہ رضی اللہ عنہا نے چاہا کہ ایک باندی کو خرید کر آزاد کر دیں، لیکن ان کے مالکوں نے کہا کہ ہم انہیں اس شرط پر آپ کو بیچ سکتے ہیں کہ ان کی ولاء ہمارے ساتھ رہے۔ اس کا ذکر جب عائشہ رضی اللہ عنہا نے رسول اللہ صلی اللہ علیہ وسلم کے سامنے کیا تو آپ صلی اللہ علیہ وسلم نے فرمایا کہ اس شرط کی وجہ سے تم قطعاً نہ رکو۔ ولاء تو اسی کی ہوتی ہے جو آزاد کرے۔ |

| Narrated `Abdullah bin `Umar: Aisha, (mother of the faithful believers) wanted to buy a slave girl and manumit her, but her masters said that they would sell her only on the condition that her Wala’ would be for them. `Aisha told Allah’s Apostle of that. He said, “What they stipulate should not hinder you from buying her, as the Wala’ is for the manumitted.” |
