| حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : ” مَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرُهَا لِلْبَائِعِ ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ ” . |

| ´ہم سے عبداللہ بن یوسف نے بیان کیا، کہا کہ ہم کو امام مالک نے خبر دی، انہیں نافع نے، انہیں عبداللہ بن عمر رضی اللہ عنہما نے کہ` رسول اللہ صلی اللہ علیہ وسلم نے فرمایا اگر کسی نے کھجور کے ایسے درخت بیچے ہوں جن کو پیوندی کیا جا چکا تھا تو اس کا پھل بیچنے والے ہی کا رہتا ہے۔ البتہ اگر خریدنے والے نے شرط لگا دی ہو۔ (کہ پھل سمیت سودا ہو رہا ہے تو پھل بھی خریدار کی ملکیت میں آ جائیں گے)۔ |

| Narrated `Abdullah bin `Umar: Allah’s Apostle said, “If somebody sells pollinated date palms, the fruits will be for the seller unless the buyer stipulates that they will be for himself (and the seller agrees). |
