| حَدَّثَنَا خَلَّادُ بْنُ يَحْيَى ، حَدَّثَنَا نَافِعُ بْنُ عُمَرَ ، عَنِ ابْنِ أَبِي مُلَيْكَةَ قَالَ : كَتَبْتُ إِلَى ابْنِ عَبَّاسٍ ، ” فَكَتَبَ إِلَيَّ إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ ” . |

| ´ہم سے خلاد بن یحییٰ نے بیان کیا، کہا ہم سے نافع بن عمر نے بیان کیا، ان سے ابن ابی ملیکہ نے کہ` میں نے عبداللہ بن عباس رضی اللہ عنہما کی خدمت میں (دو عورتوں کے مقدمہ میں) لکھا تو اس کے جواب میں انہوں نے تحریر فرمایا کہ نبی کریم صلی اللہ علیہ وسلم نے فیصلہ کیا تھا کہ (اگر مدعی گواہ نہ پیش کر سکے) تو مدعیٰ علیہ سے قسم لی جائے گی۔ |
