| حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : ” مَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ ” . |

| ´ہم سے عبداللہ بن یوسف نے بیان کیا، کہا ہم کو امام مالک نے خبر دی، انہیں نافع نے اور انہیں عبداللہ بن عمر رضی اللہ عنہما نے کہ` رسول اللہ صلی اللہ علیہ وسلم نے فرمایا ”جس نے کوئی ایسا کھجور کا باغ بیچا جس کی پیوند کاری ہو چکی تھی تو اس کا پھل (اس سال کے) بیچنے والے ہی کا ہو گا۔ ہاں اگر خریدار شرط لگا دے (تو پھل سمیت بیع سمجھی جائے گی)۔ |

| Narrated `Abdullah bin `Umar: Allah’s Apostle said, “If someone sells pollinated date-palms, their fruits will be for the seller, unless the buyer stipulates the contrary.” |
